Pixxcell Limited (“Company” or “Pixxcell”) take privacy rights and protecting the interests of Pixxcell users very seriously and we seek to ensure the highest standards of compliance with UK Data Protection Laws and Regulations. Pixxcell has an up-to-date data protection notification registered with the Office of the Information Commissioner.

This Pixxcell Privacy Policy describes how we treat personal data when you use Pixxcell services ("Privacy Policy").

The Privacy Policy also gives information about cookies, Pixxcell's and third parties' use of cookies and how you may disable such cookies.

This Privacy Policy does not apply to the practices of companies that Pixxcell does not own or control, or to people that Pixxcell does not employ or manage.

By registering via www.pixxcell.com (“Website”) or otherwise using the information and facilities provided on the Website and our other services, you give your consent to the use of your data in accordance with this Privacy Policy.   • 1. What do we mean by "Your Data"?

    "Your Data" means any information about you which is personally identifiable, including, without limitation, your name, address, date of birth, telephone numbers, email address, user name, password, comments, personal descriptions, photos and other information from which you can be identified and which you may disclose to us or otherwise via the Website at any time.

    2.1 You may view photos posted on the Website by other users without registering for an account.

    2.2 We collect Your Data from you when you:

    • 2.2.1 register via the Website whereby Pixxcell asks for some personal information when you create an account, including your email address and a password, which is used to protect your account from unauthorized access and you may also be asked to create a unique username;

    • 2.2.2 post an entry, message or comment on the Website;

    • 2.2.3 make a complaint or enquiry or provide other feedback whether to other users or to us through the Website; or

    • 2.2.4 choose to disclose your data to us or through the Website.

  • 2.3 When you use the Website, Google Analytics (on our behalf) automatically records certain data about your use. Similar to other web services, such data includes but is not limited to account activity (including storage usage and number of log-ins), data displayed or clicked on (including UI links) and other log information (including browser type, IP-address, date and time of access, cookie ID, and referrer URL).

  • 2.4 In particular, and as also appearing as a mirror clause 2.4 in Pixxcell’s terms of service, by connecting a social media account to the Website for the purposes of registration, you grant us access to your data held by that account, including photos and your friends, followers or following list (as applicable), pursuant to the terms and conditions of the relevant social media account. Pixxcell will not distribute any of your personally identifiable data from these accounts to any third parties, although you grant us a royalty free, perpetual licence to distribute your general non-personally identifiable demographic data to Getty and other relevant third parties such as information about your viewing history, age, interests and recent geographic locations visited.

  • 3. How does Pixxcell use Your Data?

  • 3.1 We use Your Data to:

    • 3.1.1 monitor, develop and improve our services, Website and your experience;

    • 3.1.2 process and administer your registration as a Pixxcell user;

    • 3.1.3 contact you with queries about your content or in order to request any additional consents required to publish it in other forms pursuant to our terms and conditions;

    • 3.1.4 process and deal with any complaints or enquiries made by or about you;

    • 3.1.5 monitor and investigate any suspected breach of our terms and conditions made by or otherwise relating to you; and

    • 3.1.6 to keep you updated with information by email about existing and new Pixxcell services that we think may be of interest to you.

  • 3.2 We reserve the right to send you certain communications, such as service announcements and administrative messages and other communications relating to the Pixxcell service, without offering you the opportunity to opt out of receiving them.

  • 3.3 Please note that although we do not monitor or vet entries and communications placed on or sent via the Website, we do reserve the right to randomly check, amend, edit or remove information or data on the Website that comes to our attention and is in breach or potentially in breach of our terms and conditions or we may ask carefully selected third parties to undertake such activities for us.

  • 4. Will Pixxcell pass Your Data to third parties?

  • 4.1 Pixxcell may pass Your Data to other people as follows:

    • 4.1.1 Your name will be publicised on the Website against any entries that you post and this will be the identity by which you are known on the Website and will therefore be available to any other users of the Website;

    • 4.1.2 Users may be able to see your photos (including any images sourced from Getty and/or Flickr) through searches on the Website, through your own website if it frames a webpage of the Website containing your story map, and through third party services that access publicly available information on the web;

    • 4.1.3 Users may comment on your photos (once this functionality has been activated by Pixxcell) and these comments can be seen by anyone who is able to access the image or story map attached to the comments, either through the Website interface, or (in the case of a photo or story map which appears on the Website’s public archive) by the general public accessing publicly available information on the web;

    • 4.1.4 To our employees, agents and partners to administer the Services and the Website and the products and services provided to you by Pixxcell now or in the future;

    • 4.1.5 In some cases we may use a technical partner to conduct some processing and storing of Your Data on our behalf in providing the Services and Website, but this is always subject to strict contractual control;

    • 4.1.6 Some general statistical information about the Services' user base, use patterns, traffic volumes and related matters may be passed on to reputable third parties but these details will not include information personally identifying you; and

    • 4.1.7 We may disclose Your Data to the police, regulatory bodies or legal advisers, your parents, teacher or legal guardian in connection with any alleged criminal offence or suspected breach of our terms and conditions by you.

  • 4.2 Always think carefully before disclosing Your Data or other information to other Website users or otherwise posting Your Data on the Website. It is important that you are aware that any of Your Data or other information which You choose to disclose on the Website may then be viewed and even used by other users. We do not control the contents of communications made between users although you can make a complaint about another user as detailed in our terms and conditions.

  • 4.5 Pixxcell may review the content of a user’s homepage if a user complaint is received, or if we have reason to believe that the account is used in violation of the Pixxcell Terms of Service.

  • 4.6 Pixxcell stores, maintains and processes your photos and account information in order to provide the Pixxcell service to you and to operate and improve our services.

  • 5. Data Security

  • 5.1 Pixxcell endeavours to take all reasonable steps to protect Your Data. All the Data collected by us is stored on a secure server. The secure server software encrypts all information you input before it is sent to us.

  • 5.2 The data that Pixxcell collects from you may be transferred to, and stored at, a destination outside the European Economic Area (“EEA”). It may also be processed by staff operating outside the EEA who work for us or a third party we collaborate with. By submitting your personal data, you agree to this transfer, storing or processing. Pixxcell will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this privacy policy.

  • 5.3 Unfortunately, the transmission of information via the internet is not completely secure. Although Pixxcell will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our Website and any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.
